"Bush Nominates Alito to Supreme Court"
As you surely know by now, Alito's nickname is "Scalito" for his Scalia-like judicial philosophy.

It's hard to believe that wackos like the religous right, Republicans and anyone born after 1800 could actually support someone like Alito, let alone Scalia!
Both of these men (old, white, of course -- typical Republican pick!) have some insane idea that the Constitution actually means something! This incredible misinterpretation of what is meant by the "rule of law" leads them to believe they should decide cases on the basis of what the Constitution actually says!
Why, the next thing you know, the radical right will be trying to twist this country into, I don't know, becoming a place where laws actually have to be followed! Can you imagine what kind of a terrible fascist society we'd have if people treated laws as though they meant something? And I suppose, to those crazies, contracts are binding, huh? Yeah, right! Only if they're interpreted in favor of the people, and not the evil business owners, land owners, or Heaven (if it existed, which it doesn't!) forbid, BIG OIL!!!
It's time we took back our country from these lunatics! Write President Bush and DEMAND that he appoint someone from France to the Supreme Court! It's the only way to carry out Justice O'Connor's belief that we should look to Europe to tell us how to interpret our Constitutional issues!
Go on, Bill! Keep fighting the good fight, and keep us away from any fascist pig who thinks we should be hog-tied by a stupid document written over two hundred years ago by a bunch of rich, old, white Christian men! Stop Alito NOW!!!
Hee ;)
Actually, though, it's Breyer who is the most outspoken about looking at what's going on in the world at large when we think about what's acceptable, i.e., executing minors, which is what the recent hullabaloo was all about (BTW, "hullabaloo" is a technical legal word. I looked it up.)
You know who else looked abroad when considering important legal issues, like, say, writing a constitution? That's right! THE FOUNDERS OF THE UNITED STATES OF AMERICA! THOSE LIBERAL NUTTERS!
On a serious note, the issue is whether the Constitution can evolve with the times. We are a very different country now then we were back then in the days of "Hey, let's make black people count as 3/5ths of human being! C'mon, who's with me?"
I'm a big fan of amending that sucker (like, to guarantee a right to vote for president -- or even the electors of the Electoral College -- which we don't even have today). And I understand the need for maintaining some coherence in constitutional interpretation.
But all of these buzzwords like "strict constructionist" and "legislate from the bench" are, in a word, hooey. When conservatives couldn't get the courts -- ANY court -- to intervene in the Terri Schiavo matter, they complained about "activist judges."
Basically, they want judges to do whatever they say, and not overturn absurd, unconsitutional legislation, of which there's been plenty recently.
OK, I'm done. It's the weekend, and I am, in a word, outta here! (OK, two words).
Thanks for the post, P-ii.
